Terms and conditions
The online estimate is non-binding. The price set after inspection is authoritative. The German version is authoritative.
§1 Scope and contracting party
These terms apply when EMERGING PARTS LTD, North West Unit 110 Compass Industrial Park, L24 1YA Liverpool, purchases used parts. Sellers may be consumers or businesses. Different terms apply only when expressly confirmed in writing.
§2 Online estimate and contract
The amount shown online is a non-binding estimate based on the part number, quantity and condition entered. A purchase contract is formed only after we inspect the received parts and expressly confirm the final purchase.
§3 Seller information and ownership
The seller must provide accurate and complete information about the parts, quantity, condition and ownership, and must be entitled to sell them without infringing another person's rights. Photographs help with the preliminary assessment but do not replace the physical inspection.
§4 Packing and delivery
Parts must be packed safely and sent to the stated receiving address with the reference supplied. Any specific delivery terms in the quotation take priority. Hazardous materials or parts leaking fluids must not be sent without prior agreement.
§5 Inspection and final price
On receipt we check identity, completeness, condition and recoverability. If the result differs from the information supplied, we will communicate a revised price or rejection. A revised price is not accepted by silence; the seller may accept it or choose the return option offered in the notice.
§6 Payment
Payment is made using the agreed method after the seller accepts the final inspection result. Any tax and business information required by law must be complete before payment. Banks and payment providers may apply their own processing times.
§7 Parts not purchased
For rejected or non-conforming parts, we will agree return, collection or another lawful treatment with the seller. Relevant costs and deadlines will be explained before a decision is required. We will not dispose of a part without an appropriate basis.
§8 Liability and complaints
Nothing in these terms excludes or limits liability where it cannot lawfully be excluded. Complaints or challenges to an inspection result should be sent to the email address in the imprint together with the quotation reference.
§9 Law and severability
The law applicable at the purchasing company's registered office applies, without affecting mandatory consumer protections or statutory jurisdiction rules. If one term is unenforceable, the remaining terms continue to apply.
